Our experience includes lawsuits related to health, disability and other benefit plans, claims of breach of fiduciary duty, executive compensation claims, and retirement plan funding. We represent clients on ERISA-related issues before a number of state and federal agencies, and have a successful track record of litigating benefits cases at both the trial court and appellate levels.
Our Employee Benefits practice group advises clients on the full spectrum of employee benefit plans, including retirement plans, such as 401(k), “New Comparability”, ESOP and pension plans; healthcare plans, including COBRA responsibilities, Flexible Spending Accounts (FSAs) and Health Reimbursement Arrangements (HRAs); and other welfare and fringe benefit programs. We have extensive experience working with nonprofit organizations and the programs that are unique to such entities, such as Tax Sheltered Annuities and Code Section 457 Plans. Our focus extends from the design and implementation of employee benefit programs, through their ongoing administration, to the termination and wind up of the arrangements.
